Terms of Service

1. Eligibility & Account Security

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You are responsible for maintaining the confidentiality of your credentials and limiting access to your account. All activity that occurs under your login is your responsibility.
• If you suspect unauthorized access, you must promptly notify Your Name - Creative Professionall so we can suspend or revoke affected sessions.

2. Permitted Use

• You may use the Services to design, publish, and manage portfolio experiences for yourself or your organization, subject to these Terms and all applicable laws.
• You agree not to misuse the Services, including by uploading malicious code, sending spam or unlawful communications, violating intellectual property rights, or attempting to compromise the security of our infrastructure.
• We reserve the right to monitor usage, investigate violations, suspend or terminate access, and remove content that breaches these Terms or applicable law.

3. Acceptable Use Policy

You may not use the Services, or any site published through them (including subdomains and connected custom domains), to host, distribute, or link to content that:

• is unlawful, or facilitates illegal activity, fraud, or scams (including phishing or deceptive solicitation);
• distributes malware, viruses, or other malicious or harmful code;
• impersonates any person or organization, or misrepresents your affiliation with them;
• is spam, or is used for bulk unsolicited messaging or deceptive search-engine manipulation;
• infringes intellectual property rights, or violates the privacy or publicity rights of others;
• is sexually exploitative of minors, promotes violence or self-harm, or constitutes harassment, hate speech, or threats.

Anyone may report a site they believe violates this policy via the “Report this site” link in the footer of a published portfolio, or at Your Name - Creative Professionall/report. We may suspend or remove any site that violates this policy, with or without notice, and may report unlawful activity to the appropriate authorities.

4. Content Ownership & Licenses

• You retain all rights to content you upload to your portfolio instance. You grant Your Name - Creative Professionall a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to provide the Services.
• You represent that you have obtained all necessary rights, permissions, and consents for content you submit, including permission to display the likeness of individuals or trademarks featured in your portfolio.
• Feedback, suggestions, or improvements you provide may be used by Your Name - Creative Professionall without obligation or compensation.

5. Hosted Instances & Visitor Data

When you deploy a portfolio instance, you are responsible for submitting accurate content and obtaining any necessary consents from your visitors. You must implement appropriate disclosures (such as privacy notices) and honor all applicable privacy, marketing, copyright, and accessibility laws. We provide infrastructure and auditing tools to help, but you are the controller of data collected on your instance. You agree to indemnify Your Name - Creative Professionall from claims arising out of content or data practices associated with your instance. Our own collection and use of technical metadata (IP address, approximate location, user agent, and similar information) is governed by our Privacy Policy and related notices, and you agree to surface appropriate consent mechanisms when required by law.

6. Payment & Subscription Terms

If you enroll in a paid plan, you authorize Your Name - Creative Professionall and its payment processors to charge the payment method you select. Subscription fees, billing cycles, and cancellation terms will be communicated at the time of purchase. Except where required by law, fees are non-refundable. We may modify pricing with prior notice.

7. Service Availability & Modifications

• We strive to maintain a reliable service but do not guarantee uninterrupted or error-free operation. Planned maintenance and emergency downtime may occur.
• We may modify or discontinue portions of the Services at any time. If a material change negatively impacts you, we will provide reasonable notice when feasible.

You agree to indemnify, defend, and hold harmless Your Name - Creative Professionall from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of your content, your use of the Services, or your violation of these Terms.

10. Termination

We may suspend or terminate access to the Services at any time if you violate these Terms or if your conduct poses risk to us, our users, or third parties. You may terminate your account at any time by contacting support. Sections that by their nature should survive termination will remain in effect, including ownership, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Your Name - Creative Professionall is established, without regard to conflict-of-law principles. Any disputes shall be resolved through good-faith negotiations. If the parties cannot reach agreement, disputes will be submitted to the courts located in that jurisdiction.

12. Changes to these Terms

We may update these Terms to reflect changes to the Services or legal requirements. We will post the revised Terms with an updated date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
